RULE 81. APPLICABILITY OF RULES

(a) To What Proceedings Applicable. These rules do not apply to actions under
statutory small claims procedure, except as permitted by Rule 69, nor to applications to
take the poor debtor's oath.

(c) Scire Facias Abolished. The writ of scire facias is abolished in civil actions. Relief
heretofore available by scire facias may be obtained by appropriate action or by
appropriate motion under the practice prescribed in these rules.

(e) Terminology and Statutes. In applying these rules to any proceedings to which they
are applicable, the terminology of any statute which is also applicable, where inconsistent
with that in these rules, shall be taken to mean the device or procedure proper under these
rules.
RULE 82. JURISDICTION AND VENUE UNAFFECTED
These rules shall not be construed to extend or limit the jurisdiction of the District Court
or the venue of actions therein.
RULE 83. RULES OF PRACTICE AND ORDERS
Rules of practice and general orders which may be adopted from time to time by a
majority of the judges of the District Court to further regulate the practice and conduct of
business therein shall be deemed adopted under the power by which these rules are made
and promulgated as well as pursuant to such other powers as the court may have. The
designation of a regulation of practice and the conduct of business as an "order" rather
than as a "rule" is for the purpose of convenience only and shall have no other effect.
RULE 84. FORMS
The forms contained in the appendix of forms are sufficient under the rules and are
intended to indicate the simplicity and brevity of statement which the rules contemplate.
RULE 85. TITLE
These rules shall be known as the District Court Civil Rules and may be cited as D.C.R.
RULE 86. EFFECTIVE DATE
These rules shall take effect on April 1, 1970. They govern all proceedings in actions
brought after they take effect and also all further proceeding in actions then pending,
except to the extent that in the opinion of the court their application in a particular action
pending when the rules take effect would not be feasible or would work injustice, in
which event the former procedure applies.
